Customer Terms of Service

1. Acknowledgement and agreement

You acknowledge and agree these terms of service (terms) govern the performance of either plumbing, electrical, heating and cooling and/or other general maintenance services (maintenance services) performed by or on behalf of Good Maintenance Operations Pty Ltd ACN 115 089 819 (GMO) at the property specified in the invoice to which these terms relate and you agree to be bound by them.

2. Acceptance

Any instructions received from you for the supply of maintenance services shall constitute acceptance of the Terms and Conditions contained herein.

3. Statutory warranties and Australian Consumer Law

  1. All maintenance services performed under these terms will comply with the statutory warranties applicable in the State where the maintenance services are performed.
  1. These terms and the maintenance services are also subject to the Australian Consumer Law set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth), which prevails to the extent of any inconsistency.

4. Latent defects and damage made in the course of repair

  1. GMO shall not be liable for any damage to framework, structure or tiles, faults, defects, deterioration or wear and tear in relation to the maintenance services that were not visible or apparent at the initial property inspection conducted but which have appeared and/or deteriorated since the date of that inspection.
  1. If an issue is found during installation, additional work may be necessary.Any additional work and costs will be discussed and approved by you before proceeding.
  1. Although all care will be taken any damage or cosmetic imperfections because of standard or quoted maintenance repairs will not fall to GMO for repair. For example if GMO replaces a heater on a wall or a light fixture and there is unpainted areas that is unsightly, or if GMO need to create new fixture holes and some old fixture holes are visible, any patching will need to be completed by others. For the avoidance of doubt, GMO will not be responsible for secondary cosmetic repairs created as a result of primary repairs for which GMO were initially engaged for.
  1. While all care will be taken to avoid damage whilst GMO completes maintenance services, GMO cannot be held responsible for any incidental damage to lawns, gardens, or other landscaping features during excavation and installation works.

5. Health and safety

  1. GMO may refuse to carry out the maintenance services if the property is reasonably deemed to be unsafe, and any such refusal will not be a breach of these terms.
  1. Working at heights - for tasks requiring work at elevated heights, an additional person is mandated to be present on-site for safety reasons

6. Access

  1. You must provide access to GMO to carry out the maintenance services as required, whereby work cannot proceed for any reason a service call will be charged and deemed payable to GMO.
  1. Delays or the need for additional visits due to inaccessible areas, unavailability of the client, or unforeseen site conditions may result in additional charges. It is essential that clear and unobstructed access to the work areas is provided to ensure efficient completion of maintenance services. Any hindrances to accessibility that impact the ability to perform the work as scheduled may necessitate a revision of the quote or incur a general service charge and potential rescheduling.
  1. GMO reserve the right to charge you a penalty fee and/or attendance fee if we attend a property at an agreed time/appointment and you fail to attend and provide access.
  1. GMO reserve the right to charge you if incorrect keys are provided and GMO are unable to access a property (e.g. wasted time travelling to an agency, travelling to job, then travelling back to agency to return incorrect keys).

7. Lateness

  1. GMO may arrive late for various reasons.All efforts will be made to arrive within the designated window however in situations where we are runny early or late, our office will communicate this with you via sms, call, and/or email, and offer to reschedule or attend outside the designated window.

8. Pets

  1. GMO may not be able to work effectively if pets are not secured appropriately

9. Cleaning up

On completion of the maintenance services GMO will remove all tools and equipment brought onto the property and dispose of all rubbish and surplus materials relating to the maintenance services. Exceptions to this, include situations where a temporary service or appliance has been installed or emergency make-safe situations.

10. Goods

  1. If a product arrives defective or damaged, GMO will promptly notify you and resolve the issue through replacement or repair.Any additional timelines and costs will be communicated to you.
  1. If an installed product or appliance fails due to manufacturer fault, GMO will charge for any investigation and warranty coordination
  1. Title passes to you following GMO receiving full payment for the goods.


11. Bathrooms

Due to the limited sizes of exhaust fans available for installation in restricted roof spaces and ducted exhaust units, there may be unavoidable condensation in tiled/solid concrete bathrooms with restricted air movement. This could result in minor moisture accumulation on surfaces, particularly in high humidity conditions. While all reasonable efforts can be made to mitigate this issue, complete prevention of condensation may not be feasible.

12. Leak Detection

  1. Please note that despite GMO’s extensive experience and expertise, identifying the source of leaks can be challenging. GMO will make every effort to resolve the leak during the initial visit; however, it may require a process of elimination, addressing the more apparent causes first and then investigating the less obvious ones. Additional unforeseen defects may also contribute to these leaks.
  1. For leak repairs, GMO offer no guarantee that the repairs will prevent future leaks. Due to the inherent nature of such leaks, GMO cannot ensure that leaks or water pooling will not recur. GMO’s warranty is limited to the workmanship of the repairs carried out and does not cover the resolution of any pre-existing defects or specific leak issues.


13. Insurances

GMO will maintain all compulsory insurances required to be maintained in connection with the maintenance services prior to commencing any work under these terms.
14. Misrepresentation

If you make any misrepresentation that results in additional work being required to complete the maintenance services, that additional work may constitute a deemed variation to the quoted price for the maintenance services and you must pay the price as varied. GMO may refuse to carry out the additional maintenance services arising from a misrepresented scope of work.

15. Quote

  1. Quotes can be broken up into multiple items. This type of quote is provided as a comprehensive package and intended to be considered together. Should there be a need for amendment to any individual items, a revised quote will be issued, causing the first quote to no longer be valid.
  1. Unless expressly stated otherwise, it is assumed all works will be completed in a single visit.
  1. Quotes for the provision of appliances are subject to GMO’s supplier pricing, factors such as availability and shipping are outside of GMO’s control and may result in a price increase from the initial quote provided. In such instances, appliance prices may alter without notice and prices charged may be different from the quote provided, GMO will endeavour to promptly communicate such price changes.
  1. In some instances, quotes can be issued by GMO site unseen. Quotes will be issued to GMO’s best knowledge based on the information provided at the time of the quote being prepared. If there are variations from the quote initially provided, any changes to works and costs will be discussed and approved by you before proceeding.
  1. Switchboard upgrades: quotes for Switchboard upgrades, assumes that existing wiring is compliant and in reasonably good condition. Please note the following scenarios:

(i) In the event of an earthing system fault/compliance issue or identification of sub-circuit faults resulting from the installation of new safety switches, additional rectification works may be necessary.

(ii) Any supplementary works required will commence only upon receiving formal approval.

  • Power outage: if applicable, in accordance with the requirements of the electrical maintenance and safety protocols, it may be necessary to temporarily disconnect the electrical power supply to the premises. Depending on works required, if the disconnection period is anticipated to exceed 12 hours to facilitate the safe execution of the required tasks you will be notified. Upon acceptance of the quotation, the occupant is to be notified of this requirement and is responsible for making all necessary arrangements to mitigate the impact of the power disconnection. This includes, but is not limited to, securing alternative power sources if deemed necessary, safeguarding perishable goods, and adjusting personal or business operations to accommodate the absence of electrical power during the specified period. Following the disconnection of electrical power, there will be no claim on GMO.

16. Deposit

  1. GMO may require payment of a 50% deposit for any maintenance services before commencing work (deposit).
  1. In that event, you must pay the deposit in accordance with the deposit invoice.
  1. GMO will not start performing any maintenance services until a required deposit has been paid.

17. Payment

  1. You must pay in full each invoice issued for maintenance work COD of the date of the invoice.
  1. A credit card fee will be charged if payment pays by a credit card.
  1. Interest will be charged on overdue amounts at the rate of 2.5% per month until all overdue amounts are paid in full.
  1. In the event payment is not made in full by the due date, then debt may be referred to a collection agency for recovery.
  1. Legal and/or collection agency costs (including but not limited to charges and commissions) of recovery of any overdue amounts shall be recoverable by you as a debt due.
  1. Any dispute of payment must be provided in writing to GMO within 5 days of invoice date.

18. Time

  1. Where adverse weather or unexpected challenges affect the project’s timeline. GMO will strive to minimise delays. Where the delay is by reason of any acts or omissions of something required to be done by you, you agree to extend the timeline. Any timeline extension shall be GMO’s sole remedy in respect of any delay caused by you.
  1. Return visits – some maintenance such as roof leaks or intermittent electrical faults may, by their nature require multiple visits. Any subsequent visits after an initial visit will not be deemed a warranty or callback and will be subject to normal pricing.

19. Limitation of liability

To the extent permitted by applicable law, the maximum amount for which GMO may be liable to you under these terms and/or in respect of maintenance services, whether in contract, tort (including negligence), under statute or otherwise, is the price paid by the you for those maintenance services.


20. Cancellations

  1. Special orders, including custom-made or non-stock items, require significant investment and are often non-returnable. Cancellations received of such work orders will incur a cancellation fee of up to 100%, depending on the status of the work order.
  1. Any job cancellations less than 2 hours before commencement of job will incur cancellation charges.

21. Warranties

  1. All Goods carry only such warranty, if any, as furnished by the manufacturer (the period stated on the Warranty Terms and Conditions card enclosed with Goods) or as implied by law.

22. Termination

You may terminate these terms by notice in writing to GMO, if:

  1. GMO goes into liquidation or administration or ceases, or indicates that it is about to cease, carrying on its business, subject to any law suspending or preventing the exercise of a termination right in the relevant circumstances; or
  1. GMObreaches a material term of these terms which in your reasonable opinion:
  1. is not capable of being remedied; or
  1. is capable of being remedied but is not remedied by GMO within a reasonable period.

23. Entire agreement

These terms set out the entire agreement between the parties and supersede all other communications, negotiations, arrangements and agreements between the parties whether oral or in writing in connection with the subject matter of these terms.

24. Governing law

These terms are governed by the laws of the State in which the maintenance services are carried out by or on behalf of GMO. Each party irrevocably submits to the exclusive jurisdiction of the courts of that State.
